Privacy Policy

This Privacy Policy describes our policies on the collection, use, and disclosure of information about you in connection with your use of our services, including those offered through our websites, communications (e.g., emails, phone calls, and texts), and mobile applications (collectively, the " Site " or the " Service ”). The terms “we”, “us”, and “the Company” refer to Resident Review, Inc., a Delaware corporation with its headquarters in Fort Myers, Florida.

When you use the Service, you consent to our collection, use, and disclosure of information about you as described in this Privacy Policy. We may translate this Privacy Policy into other languages for your convenience. Nevertheless, any inconsistencies among the different versions will be resolved in favor of this English-language version.

1. INFORMATION WE COLLECT AND HOW WE USE IT. We may collect, transmit, and store information about you in connection with your use of the Service, including any information you send to or through the Service. We use that information to provide the Service’s functionality, fulfill your requests, improve the Service’s quality, engage in research and analysis relating to the Service, personalize your experience, track usage of the Service, provide feedback to business users that are listed on the Service, display relevant advertising (including third-party advertising), market the Service, provide customer support, message you, back up our systems, allow for disaster recovery, enhance the security of the Service, and comply with legal obligations. Even when we do not retain such information, it still must be transmitted to our servers initially and stored only as long as necessary to facilitate processing.

a. Account Information: When you create a Company account, we store and use the information you provide during that process, such as your first and last name, your business name, your business license number or taxpayer identification number, email address, zip code, physical address, phone number, and any other information you may provide during the account creation process. We may publicly display the name of your business, your first name and last initial that you provide, as well as any other content you submit through the account creation process, as part of your account profile, unless you opt out through your account settings. You can later modify some of the account information you provide through your account settings. If you believe that someone has created an unauthorized account using your personal information, you can request its removal by flagging it.

b. Public Content: Your account profile (e.g., first name, last initial, city, the month and year you created your account), and contributions to the Service are viewable by the other members of the Service, including your ratings, reviews and edits to business page information. You can limit the public visibility of some of these activities through your account settings.

c. Communications: When you sign up for an account or use certain features, you are opting to receive messages from the Company. You can manage some of your messaging preferences through your account settings, but note that you cannot opt out of receiving certain administrative, transactional, or legal messages from the Company. We may also track your actions in response to the messages you receive from us or through the Service, such as whether you deleted, opened, or forwarded such messages. If you send or receive messages through the Service via SMS, we may log phone numbers, phone carriers, and the date and time that any messages were processed. Carrier message and data rates may apply. We may also store information that you provide through communications with us, including from phone calls, letters, emails and other electronic messages, or in person. Any of our communications with you, including any phone calls, may be monitored and recorded for quality purposes.

d. Payment Transactions: We use Stripe, a PCI DSS compliant third-party payment processor, to handle transactions securely. When you make a payment, your payment information is collected and processed by Stripe in accordance with their privacy policy. We do not store your credit card details on our servers. Stripe ensures the security of your payment information through encryption and other security measures. e. Activity: : We store information about your use of the Service, the features you use and the date and time of your visits. We also store information that your computer or mobile device may provide to us in connection with your use of the Service, such as your browser type, type of computer or mobile device, browser language, IP address, WiFi information such as SSID, mobile carrier, phone number, unique device identifier, advertising identifier, location (including geolocation, beacon based location, and GPS location), and requested and referring URLs and mobile applications. We may also receive and store your location whenever our mobile applications are running, including when running in the background, if you enable our mobile apps to access such information in the course of using the Service. You may be able to limit or disallow our use of certain data through your device or browser settings, for example you may be able to limit or disallow our collection, use or sharing of location data or mobile advertising identifiers by adjusting the settings for our applications in iOS or Android privacy settings.

f. Different Devices: You may access the Service through different devices (e.g., your mobile phone, personal computer, or other internet connected device) and different platforms (e.g., through the Site or the Company mobile apps). The information that we collect and store through those different uses may be cross-referenced and combined, and your contributions through one the Company platform will typically be similarly visible and accessible through all other the Company platforms.

g. Professional Information: As a business user, we may collect and display information about you related to your business activities, such as a business name that may incorporate your individual name, or a publicly available business address that is also used as a home address. We will also collect and display information about your professional background that you choose to share with us through the Service, such as information about your professional licenses or certifications, or your professional history or specialties.

h. Sensitive Personal Information: In the course of using the Service, you may choose to allow the Company to collect and store sensitive personal information about you, such as your precise geolocation. You may choose to share other sensitive personal information through the content you share on the Company, for example, when leaving a review, or otherwise sharing information on the Site. You may be able to limit or disallow our collection, use or sharing of location data by adjusting the settings for our applications in iOS or Android privacy settings. You can remove content that may include sensitive personal information through your account settings.

Property and Third-Party Data: We may obtain property-related information from public records, data licensors, property-data providers, and other lawful third-party sources, including providers such as ATTOM Data Solutions. This information may include property addresses, ownership and occupancy indicators, parcel and property characteristics, transaction or assessment information, and other property-related attributes. We may match this information with information submitted through the Service to confirm ownership, provide context for reviews, improve data accuracy, prevent fraud or misidentification, and support lead qualification. Property information may be visible to verified business users when associated with a customer review or search result. Third-party property data may be incomplete, delayed, or inaccurate and does not replace a user's obligation to obtain and document any consent required to submit a review.

2. COOKIES. We, and our third-party service providers, may use cookies, web beacons, tags, scripts, local shared objects such as HTML5 and Flash (sometimes called “flash cookies”), advertising identifiers (including mobile identifiers such as Apple’s Identifier for Advertisers (“IDFA”) or Google’s Advertising ID (“GAID”)) and similar technology (“Cookies”) in connection with your use of the Service, third party websites, and mobile applications. Cookies may contain unique identifiers, and reside, among other places, on your computer or mobile device, in emails we send to you, and on our web pages. Cookies may transmit information about you and your use of the Service, including data used for the purpose of serving third-party advertisements, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have interacted with, and the date and time of your use. Cookies may be persistent or stored only during an individual session. We will not use persistent cookies without your consent unless necessary for the core functionality of our Service.

You can also set some Cookie preferences through your device or browser settings, including preferences related to third-party advertisements, but doing so may affect the functionality of the Service. The method for disabling Cookies may vary by device and browser, but can usually be found in your device or browser preferences or security settings. For example, iOS and Android devices each have settings which are designed to limit forms of ad tracking. Please note that changing any of these settings does not prevent the display of certain advertisements to you.

3. THIRD PARTIES.Third parties may share, receive or process information about you as follows:

a. Advertisers: We may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Service and other websites or online services, based on information relating to your access to and use of the Service and other websites or online services. To the extent permitted by applicable law, we may share with these third parties such information as your IP address, device identifiers, and other information about your use of the Service. You have choices via your cookie preferences regarding the collection and use of your information by third parties for advertising purposes.

b. Content and Data Partners: We allow third party partners to use and display some of the public content available through the Service, such as your reviews, and other information listed under “Public Content” in Section 1 above.

c. Acquired Data: The Company may acquire information enabling us to identify and contact representatives of local businesses from third parties. Such acquired data may be combined with other data the Company receives from or about you, and used for the purposes described in Section 1 of this Privacy Policy.

d. Company’s Service Providers:We may rely on third-party service providers to support or provide services for us in connection with your use of the Service, such as communications and hosting, security and fraud prevention, technical and customer support, tracking and reporting usage of the Service, quality assurance testing, payment processing, marketing, and other functions. We share information from or about you with these third-party providers so that they can perform their services or complete your requests. For example, we may share your advertising identifiers (e.g., your IDFA, GAID, or a cryptographic hash of your email address) with third-party service providers that help us facilitate the Company’s advertising programs and measure and report their effectiveness, including with third parties that help determine the efficacy of the Company’s advertising programs by combining information they receive about you from other sources than the Service. The Company shares personal information with its service providers subject to obligations consistent with this Privacy Policy, and on the condition that personal information is only used on the Company’s behalf and pursuant to our instructions. You may be able to limit our access to some of this information through your mobile device settings, as described in Section 2 above, or through the Service’s settings. The Company’s third-party service providers may likewise share information with us that they obtain from or about you in connection with providing their services or completing your requests.

e. Aggregate or Anonymous Information:We share user information in the aggregate with third parties, such as advertisers or content distributors. For example, we may disclose the number of users that have been exposed to or interacted with advertisements on our Site.

f. Business Transfers: We may share information from or about you with our parent companies, subsidiaries, joint ventures, or other companies under common control, and require them to also honor this Privacy Policy. If another company acquires us, or all or substantially all our assets, that company will possess the same information, and will collect, use, and disclose the information only as described in this Privacy Policy.

g. Businesses on the Site: We may share information from or about you (such as your city, or your business type), your device type, and your use of the Service (such as any reviews that you post) with other users of the Service. Keep in mind that other uses can also view your public activity and posts (see Section 1 above).

h. Investigations and Legal Disclosures: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure: (a) is reasonably necessary to comply with legal or law enforcement processes, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process or law enforcement request; (b) is helpful to prevent, investigate, or identify possible wrongdoing in connection with the Service; or (c) protects our rights, reputation, property, or that of our users, affiliates, or the public. If you flag or otherwise complain to us about content through the Service, we may share the substance of your complaint with the contributor of that content in order to provide an opportunity for the contributor to respond.

i. Links: The Service may link to third party-controlled websites, like a business’s URL. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices.

j. Interaction With Third-Party Platforms: If you sign up for, or log into, the Company using a third-party platform like Facebook or Google, or link your account with a third-party platform like Facebook, Instagram or Twitter, Angi or Yelp, we may receive information about you from such third-party platform. Some of our web pages utilize framing techniques to serve content to you from third-party platforms, while preserving the look and feel of the Service. In such cases, please note that the information you provide may be transmitted directly to the identified third party. If you interact with businesses through the Company, they will receive whatever information you choose to share with them. The Company may share information with third parties where you direct the Company to do so through the Service.

5. CHILDREN. Our Site is not intended for children under the age of 18. We do not knowingly solicit or collect information from any individuals under the age of 18. For information about the Children’s Online Privacy Protection Act (COPPA), visit the FTC website: www.ftc.gov.

6. SECURITY. We use various safeguards to protect the personal information submitted to us, both during transmission and after we receive it. However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security

7. BREACH NOTIFICATION In the event of a data breach, defined as unauthorized access to or disclosure of personal data, we will promptly evaluate the risk to individuals' rights and freedoms and, if appropriate, report this breach to the relevant supervisory authority within 72 hours. Affected individuals will be informed without undue delay, particularly if the breach could result in a high risk to their rights and freedoms. Notifications will detail the nature of the breach, categories and approximate number of individuals and records concerned, likely consequences, measures taken to address the breach, and guidance to mitigate potential adverse effects. Users may need to change passwords or monitor their accounts for suspicious activity.

8. CALIFORNIA RESIDENTS: YOUR CALIFORNIA PRIVACY RIGHTS. Under the CCPA/CPRA, California residents have certain rights related to the Company’s collection, use, and sharing of their Personal Information, including the right to know, delete, and opt-out of the sale of their Personal Information.

If you are a resident of California, you have the following rights to your Personal Information under the CCPA/CPRA:

Access to Specific Information and Data Portability.. You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the last 12 months. You also have the right to receive your Personal Information in a structured and commonly used format so that it can be transferred to another entity.

Request Deletion.. You have the right to request that we delete specific pieces of your Personal Information that we collected from you and retained, subject to certain exceptions.

Request Correction. In certain circumstances, you have the right to request correction of any inaccurate Personal Information.

Right to Opt-Out/Do Not Sell My Personal Information. While we do not sell Personal Information in exchange for monetary consideration, we do share Personal Information for other benefits that could be deemed a “sale,” as deemed by the CCPA (Cal. Civ. Code 1798.140(t)(1)). We support the CCPA/CPRA and wish to provide you with control over how your Personal Information is collected and shared.

Limit Use and Disclosure of Sensitive Personal Information. Company generally does not seek data that may be considered Sensitive Personal Information ("SPI") (e.g., government-issued identification numbers or information related to an individual’s racial or ethnic origin, political opinions, religious or other beliefs, health, criminal background, or trade union membership) from visitors of this Site. Company requests that you do not provide us with SPI. If we specifically require the use of SPI, we will request your consent to use the data in accordance with this Privacy Notice and/or in the ways described at the point where you were asked to disclose the data. If you voluntarily share with us any SPI for any reason, you consent that we may use such data in accordance with applicable law and this Privacy Notice.

Not to be Retaliated Against for Exercising RightsCompany will not discriminate against you for exercising any of the rights afforded to you under the CCPA/CPRA.

Separate from the CCPA/CPRA, California’s Shine the Light law gives California residents the right to ask companies what Personal Information they share with third parties for those third parties’ direct marketing purposes. We do not disclose your Personal Information to third parties for the purpose of directly marketing their goods or services to you.

How to Exercise Your Rights Under the CCPA/CPRA

To exercise the access, data portability, deletion, correction, and restriction of SPI rights described above, please submit a verifiable consumer request to us by contacting us at info@resident-rev.com

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may only make a verifiable consumer request for access or data portability twice within a 12- month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. We are required to verify your identity in order to process your request.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format.We endeavor to respond to a verifiable consumer request within 45 days of its receipt, unless we need additional time, in which case we will let you know. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance

If your requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may charge a reasonable fee taking in account the administrative costs of providing the information or taking the action requested, or refuse to act on the request and notify you of the reason for refusing the request.

We value your privacy and will not discriminate in response to your exercise of privacy rights.

Updating Information

Any request to review, correct, update, change or delete your Personal Data with the Company depends upon where you are located. Contact us at info@resident-rev.comfor more information.

If you use the Resident Review platform, you can simply log into your account, go to your user profile, review your Personal Data and, if you wish, edit it with the options provided. If you are unable to edit your Personal Data by logging into your account, then please contact us for assistance. Homeowner and Resident Inquiries: If you are a homeowner or resident and believe that a review, customer record, property association, ownership indicator, or other information associated with you is inaccurate or has been misidentified, you may contact us through resident-rev.com/contact or at info@resident-rev.com. We may request information reasonably necessary to verify your identity and relationship to the relevant person or property before acting on a request. We will review verified access, correction, deletion, restriction, or dispute requests in accordance with applicable law and our legal obligations.

9. EUROPEAN RESIDENTS: YOUR PRIVACY RIGHTS AND INTERNATIONAL DATA TRANSFER

If you are a European Resident, you have the right to access your personal data, and the right to request that we correct, update, or delete your personal data. You can object to the processing of your personal information, ask us to restrict processing of your personal information, and request portability of your personal information. Additional information regarding your exercise of these rights is available through the Support Center. Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

The Service generally provides you with a reasonable means to view and change your profile information and you can opt-out of marketing communications at any time by clicking on the “unsubscribe” or “opt-out” link in the marketing emails we send you or in your account settings. If you have any questions or comments about the processing of your personal information, you may contact us as described in Section 10 below.

For European Residents, please note that the personal information we obtain from or about you may be transferred, processed, and stored outside of the EEA, United Kingdom or Switzerland for the purposes described in this Privacy Policy, including in the United States of America. We take the privacy of our users seriously and therefore take steps to safeguard your information, including ensuring an adequate level of data protection in accordance with E.U. and United Kingdom standards in effect as of the date of this Privacy Policy. These steps include use of Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect European Residents’ personal information in accordance with applicable data protection laws. We have implemented similar appropriate safeguards with our third party service providers and partners and further details can be provided upon request.

For European Residents, our legal basis for collecting and using the information described above will depend on the specific information concerned and the context in which we collect it. We, however, will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person (for instance, to prevent, investigate, or identify possible wrongdoing in connection with the Service or to comply with legal obligations). 10. MODIFICATIONS TO THIS PRIVACY POLICY.We may modify this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our collection, use, and disclosure of information about you and will be located here. If we make material changes to this Privacy Policy, we will notify you by email and/or by posting a notice on the Service prior to or on the effective date of the changes. By continuing to access or use the Service after those changes become effective, you acknowledge the revised Privacy Policy.
